Help Maintain Tune Drive and Calle Feliberto

Tune Drive

The Tune Drive Road Maintenance Association (TDRMA) (formally Stagecoach Hills Road Maintenance Association) was incorporated February 24, 2023. Bylaws were filed in Taos County, NM on March 23, 2023.

The purpose of the Association is to maintain approximately 5 miles of Tune Drive starting at Hwy 64 and ending at the end of Camino de Margarita/Tune Drive and Tune Drive at the curve going east from the intersection of Tune Drive and Camino de Margarita for approximately ¼ mile. This is done by collecting funds from property owners using Tune Drive to access their property.

A suggested annual fee is set at an annual meeting in February of each year. Additionally, a Road and Utility Maintenance Agreement is attached or referenced in some property owner’s deeds that legally obligates them to, at a minimum, $10/acre per year.

The current annual cost of maintaining Tune Drive exceeds the current total of dues collected. In 1991 when George Tune and others set up the Stagecoach Hills Road Maintenance Agreement (SHRMA) the dues were set at $10/acre. They made no provision for increasing the dues as the years went by and maintenance costs have increased.

We currently collect about $12,000 per year and that is not sufficient to do maintenance and make improvements to the road. We ask landowners in the Tune Tract who do not have the SHRMA attached to their deed to voluntarily contribute by paying what they can to help maintain the road that they also use.

SOME HISTORY:
The Stagecoach Hills Road Maintenance Agreement is a legal agreement that is on file in Taos County, Taos, New Mexico. It was filed on August 13, 1991, and recorded in book M-144, pages 845-849. As part of this agreement, Tune Drive was established as an easement and falls under the umbrella of easement law in the state of New Mexico. The owners were George and Margaret Tune, Charles Lonsdale, and Richard and Janice Stumph.

The purpose of the agreement was to establish a means to maintain and repair Tune Drive, Camino de Margarita (now part of Tune Drive) and Padilla Road (utility easement only). The intention of the property owners was to attach the agreement to deeds as property was parceled and sold. Today, some deeds have this agreement attached to their deeds and others don’t. If you have it, it is attached to your warranty deed, and you are legally required to pay $10/acre per year for maintenance of Tune Drive.

The TDRMA document includes a provision for managing the maintenance and repair of Tune Drive. The TDRMA organization is separate from other road maintenance associations, and it is not part of the Stagecoach Hills Neighborhood Association (SNA).

In order to keep up with the rising costs of maintenance, for property owners using Tune Drive to access their property, we ask for a donation of $100 per parcel of undeveloped land and $300 per parcel of developed land per year, in place of the $10/acre. This enables us to grade twice a year, spread material in needed areas, snow plow when needed and maintain signage.

Calle Feliberto

The Calle Feliberto RMA was founded in 2007. The purpose of our road association is to maintain our road through the collection of dues. The dues are currently established at: $25/yr Legacy Family, $150/yr undeveloped lot, $300/yr lot with house, the current construction fee is $300/year upon initiation of construction and payable until the construction is complete. Additional voluntary contributions to the Road Maintenance Association will contribute to an upgrading of the road materials. May we suggest $365/year or $1/day.
